Terms of Service

Welcome to Palettise. These Terms of Service (“Terms”) govern your access to and use of the Palettise website, platform, and services (collectively, the “Service”) operated by Palettise (“we”, “us”, or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Accounts

To access certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You must provide accurate, current, and complete information during registration and keep your account details up to date. We reserve the right to suspend or terminate accounts that contain inaccurate information or violate these Terms.

You must be at least 16 years of age to create an account and use the Service.

2. Use of the Service

Palettise provides an AI-powered design system generator that allows you to create, manage, and export design systems. You may use the Service for personal and commercial purposes in accordance with these Terms.

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
  • Attempt to gain unauthorised access to any part of the Service, other accounts, or any systems or networks connected to the Service
  • Interfere with or disrupt the Service or servers or networks connected to the Service
  • Use any automated means (bots, scrapers, crawlers) to access the Service without our prior written consent
  • Reverse-engineer, decompile, or disassemble any aspect of the Service
  • Upload, transmit, or distribute any malicious code, viruses, or harmful content
  • Resell, redistribute, or sublicense access to the Service without our prior written consent

3. AI-Generated Content

The Service uses artificial intelligence to generate design systems based on your inputs. You acknowledge that:

  • AI-generated outputs may vary and are not guaranteed to meet specific requirements or expectations
  • You are responsible for reviewing and validating all AI-generated content before use in any project or production environment
  • Similar inputs from different users may produce similar or identical outputs

4. Intellectual Property

Your content: You retain ownership of any content you provide as input to the Service. By using the Service, you grant us a limited licence to process your inputs solely for the purpose of providing the Service to you.

Generated outputs: Subject to your compliance with these Terms and any applicable subscription plan, you own the design systems and outputs generated through your use of the Service. You are free to use, modify, and distribute your generated outputs for personal and commercial purposes.

Our platform: The Service, including its software, design, branding, and all associated intellectual property, remains the exclusive property of Palettise. Nothing in these Terms grants you any right, title, or interest in our platform beyond the limited right to use the Service as described.

5. Subscriptions and Payments

Certain features of the Service require a paid subscription. Payment is processed securely through our third-party payment provider, Stripe. By subscribing to a paid plan, you agree to:

  • Pay the applicable subscription fees as described on our pricing page at the time of purchase
  • Recurring billing at the interval specified by your plan (monthly or annually) until you cancel
  • Provide accurate and complete billing information

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. We do not offer refunds for partial billing periods unless required by law.

6. Free and Pro Plans

The Service offers a free tier with limited features and a Pro tier with enhanced capabilities. We reserve the right to modify the features, limitations, and pricing of any plan at any time. We will provide reasonable notice of material changes to paid plans.

7. Community Gallery

The Service includes a community gallery where users may choose to share their generated design systems publicly. By publishing a design system to the gallery, you:

  • Grant other users a non-exclusive, royalty-free licence to view and draw inspiration from your shared work
  • Acknowledge that publicly shared systems may be viewed, saved, or referenced by other users
  • Retain ownership of your shared content and may remove it from the gallery at any time

8. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. We may delete your account data after a reasonable retention period following termination.

You may terminate your account at any time by contacting us at hello@palettise.com or through your account settings.

9. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any AI-generated outputs will be accurate, complete, or suitable for your intended purpose.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Palettise and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of the Service.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim, or fifty pounds sterling (£50), whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless Palettise and its directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the “Last updated” date. Your continued use of the Service after such changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
